1. Agreement to Terms

By accessing or using Digital Menu ("the Service"), operated by Kemelyen Life Designs LLC, you agree to be bound by these Terms of Service.

2. Description of Service

Digital Menu is a web-based restaurant menu management platform that allows restaurants, bars, and food service businesses to create, manage, and display digital menus. The Service includes:

  • A management dashboard for creating and editing menu items
  • Publicly accessible menu pages with unique URLs
  • Real-time availability toggling (86'd items)
  • QR code generation for customer access
  • Brand customization (colors, fonts, logos, images)
  • CSV bulk import functionality

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You must be at least 18 years old to create an account.

4. Subscription Plans and Billing

  • Free Plan: Limited items, basic features. No payment required.
  • Paid Plans: Billed monthly or annually. Payment processed through Stripe.

5. Acceptable Use

You agree not to use the Service for unlawful purposes, upload infringing content, or attempt unauthorized access.

6. Content and Data Ownership

You retain all ownership rights to the content you upload. We do not claim ownership of your content.

7. Service Availability

The Service is provided "as is" and "as available." We strive for high availability but do not guarantee uninterrupted access.

8. Limitation of Liability

Kemelyen Life Designs LLC shall not be liable for indirect, incidental, special, or consequential damages.

9. Indemnification

You agree to indemnify and hold harmless Kemelyen Life Designs LLC from claims arising from your use of the Service.

10. Cancellation and Termination

You may cancel at any time. No cancellation fees or long-term contracts. 7-day refund policy on paid plans.

11. Modifications to Terms

We may update these Terms. Material changes will be communicated by email or in-app notice.

12. Governing Law

These Terms are governed by the laws of the State of Colorado, United States.
